Terms and scope

These terms and conditions (hereinafter referred to as: the “Terms”) are important for your use of our website and the services provided via the platform. www.3co.nl are offered. We kindly request that you read them carefully.

By using the platform and/or purchasing services or products via the platform, you confirm that you understand, accept and agree to be bound by these Terms. If you do not agree, please do not use our website and the associated services.

You are responsible for complying with these Terms, as well as any other terms or requirements that apply to the use of our platform or services.

3CO reserves the right to:
- to refuse, interrupt or permanently block any user from accessing the platform;
- to limit or refuse the provision of products or services via the platform.

These Terms may change from time to time. We therefore recommend that you consult them regularly. If required by law, we will inform you about important changes in good time.

The platform

A modified version of the Terms is effective from the time of publication on the platform and is effective upon your next use.

User account

When you use a service, the then-current Terms apply. Any subsequent changes do not affect previous rights or obligations.

Deviations from these Terms are only valid if they have been expressly agreed in writing between the parties.

Adonis2 B.V. with trade name 3CO (hereinafter also: “3CO”, “we”, “us” or “our”) manages a digital health platform that focuses on both men and women. The focus is on dermatological health (the “Indications”) and the platform is available to patients, customers, and other users (“you”, “your”) (the “Platform”).

Payment

3CO does not provide medical care itself, but connects users via the Platform with independent doctors (the “Healthcare Providers”) and a partner pharmacy to provide medical services and products. The services we provide (hereinafter: “Services”) consist of:
- developing, managing and making available the Platform;
- providing information about the relevant health areas and possible treatment options;
- facilitating medical consultations and related communication between you and a Healthcare Provider via the Platform;
- making it possible to purchase prescription medicines and over-the-counter medicines from our partner pharmacy;
- the direct sale and delivery of other non-prescription products via the Platform, including logistical processing (“Direct Sales”).

Subscriptions

We do not act as a pharmacy, but work with De Regenboog Apotheek Bavel B.V. (the “Pharmacy”) to dispense and deliver prescription medicines as well as over-the-counter medications.

Invoices

‍
It is important to note that the products and services available via our platform are usually not covered by your health insurance. This means that in most cases you will bear the costs yourself. Coverage by a health insurer depends on your personal policy conditions and is not our responsibility.

Right of withdrawal - return policy

If services are available that may be covered by your health insurance, we recommend that you contact your insurer yourself to check whether you are entitled to compensation. Whether costs are reimbursed is entirely up to your health insurer.

Exceptions to no refund

Our role is only facilitative: we provide access to medication through cooperation with the Pharmacy, but have no influence on health insurers' decisions regarding reimbursement.

Your Responsibilities

3CO reserves the right to make changes to the content or design of the Platform at any time.

Privacy and personal data

3CO attaches great importance to protecting your privacy and personal information. We always treat your information confidentially and in accordance with applicable privacy laws, including the General Data Protection Regulation (GDPR).
Your personal data will only be used to provide our services, facilitate contact with Healthcare Providers and Pharmacies, and process orders via the Platform. For detailed information about how we handle your data, please refer to our full privacy policy at: www.3co.nl/privacy-policy.

Cookies

3CO uses cookies: small text files that are temporarily stored in the memory of your device or hard drive. Cookies allow us to recognize your device and collect information about how visitors use the Platform. This helps us improve the user experience and better tailor the Platform to your needs.
In addition, we may use third parties to show ads on other websites based on your previous visits to our Platform. These parties can use anonymized data to personalize ads and optimize campaigns.

The Services offered via the Platform are only available to persons who:
be at least 18 years old;
- are living in the Netherlands;
- using the Platform from the Netherlands;
- be able, if applicable, to independently consent to medical treatment (as determined by a Healthcare Provider);
- have created a personal account on the Platform, if the service involves medical treatment;
- have the legal capacity to enter into a binding agreement with us; and
agree to these Terms and the associated Privacy Policy.

Liability

3CO has compiled the information on the Platform with the utmost care. However, we cannot guarantee that all information is complete, accurate or up to date. We accept no liability for direct or indirect damage resulting from the use of the Platform, incorrect or incomplete information, or the unavailability of the Platform or linked applications and websites. Obvious errors or typos do not bind 3CO.

The Platform may contain links or content from third parties (“Third Party Content”), including links to websites operated by third parties (“Third Party Sites”). Such content is beyond 3CO's control. We do not monitor or endorse these external sources and cannot guarantee them. Use of or reliance on Third Party Content or Third Party Sites is at your sole risk. We are not liable for any damage that occurs as a result.
The content on the Platform is for general information only and is not intended to provide individual medical or therapeutic advice or as a substitute for a consultation with a qualified healthcare provider.

3CO does not guarantee the operation or effectiveness of products offered via the Platform. We also cannot take responsibility for the content of package inserts, informative texts or treatment descriptions. 3CO itself does not provide medical or legal advice and does not provide diagnostic services. If you act on the basis of information on the Platform, you do so entirely at your own risk.
You should be aware that online consultations are subject to restrictions. There is no physical examination and no face-to-face contact possible, so certain medical restrictions cannot always be fully assessed.

For damage resulting from errors or shortcomings on the part of the Pharmacy, you have to rely on the Pharmacy. He is independently responsible for the supply of medicines and compliance with the agreement concluded with you.
The Healthcare Providers are responsible for making diagnoses, prescribing medication and the content of the medical consultation. 3CO cannot be held responsible for this.

You agree to indemnify 3CO, its employees, partners, directors, suppliers, and other related parties from any claims or damages (including reasonable legal fees) resulting from your breach of these Terms, unlawful use of the Platform, or infringement of third party rights or legal obligations.
3CO is not responsible for the content posted on the Platform by other users or third parties. Therefore, opinions, statements or advice that do not originate from 3CO do not represent 3CO's position.

To the fullest extent permitted by law, we exclude any liability for indirect or consequential damage resulting from the use of — or inability to use — the Platform or the information contained therein.

3CO is not liable for the delivery of medical services or products by Healthcare Providers or Pharmacies. The responsibility for clinical care, including the provision of medication, lies exclusively with these parties. 3CO only acts as a facilitator.

If you find any inaccuracies on the Platform or have suggestions for improvement, we would appreciate it if you inform us about this at info@3co.nl.

Most Services provided via the Platform (excluding direct sales of non-prescription drugs) require registration. During the registration process, you provide personal information such as your name, date of birth, gender, contact details and health-related information. We process this information in accordance with our Privacy Policy. Registration makes it possible for us to recognize you in case of repeat purchases or requests to change, cancel or cancel. We can also check whether there are any medical contraindications based on your order history. If necessary, we can inform you, advise you or refuse the order. Registration also helps prevent abuse.

Intellectual Property

Use of the Platform is only allowed for personal, non-commercial purposes.

The content of the Platform is aimed at consumers aged 18 and over who reside within the European Union.

All texts, images, tables, brand names, designs, ideas and other elements on the Platform are protected by intellectual property rights, including copyrights, database rights and trademark rights. These rights are owned by 3CO or its licensors.

Any use of the Platform that goes beyond what is expressly permitted by applicable law or these Terms is prohibited. Information such as text, audio, images, and source files may only be used for non-commercial purposes. Any other use, such as editing, publishing or copying (parts of) the Platform, requires 3CO's prior written consent. We expressly reserve all rights.

You cannot rely on the protection of your own databases or derivative works based on information from the Platform. Commercial use of such derivative data violates the rights of 3CO and its licensors.

All content on the Platform — including text, prices, logos, designs, downloads, images, and product information — is owned or licensed by 3CO. You may not copy, resell, edit or store them for purposes other than those described in these Terms without our written permission. We expressly reserve all rights.

3CO respects the intellectual property rights of third parties and expects users of the Platform to do the same. Use of our Services or access to the Platform does not grant any rights to the content or any part of it, except as expressly provided in these Terms.

You agree that all information you provide via the Platform (including information to Healthcare Providers) is accurate, complete, and current and that you are not withholding relevant information that is relevant to the Services that you purchase.

Warranties and indemnities

By using the 3CO Platform, you agree that:
- you accept all risks associated with the use of digital services, including the risk of your device, software or data being damaged by viruses from the Platform or external sources;
- the communication you have with our employees (with the exception of Healthcare Providers) does not constitute medical advice;
- 3CO does not make medical diagnoses or provide immediate care; you should always seek professional medical advice from a healthcare provider or your own doctor to determine whether a treatment or medication is appropriate and safe for you;
- the information on the Platform is intended as a general explanation, and while we strive for accuracy, we cannot guarantee that the information is complete, current or error-free. You should not consider this information as a substitute for medical advice tailored to your personal situation;
- 3CO does not express a preference or recommendation for certain Healthcare Providers, treatments or products. It's up to you and your doctor to decide what's best for you.

To the fullest extent permitted by law, 3CO excludes all implied and explicit warranties or representations with respect to the Platform or its content.

We do not guarantee that the products and services available via the Platform are suitable for your specific situation. Everything is provided as offered, with no warranty of any kind.

Nothing in these Terms is intended to exclude or limit any rights that you may have under consumer law or other mandatory regulations.

If there is reasonable doubt about the accuracy of the information you provide, you may be asked to provide additional identification.

Complaints

In the unlikely event that something goes wrong, we would love to hear about it. You can file complaints by sending an email to: info@3co.nl. We take your complaint seriously and strive for a quick and appropriate solution.

You are only allowed to request a consultation for yourself. Attempts to complete a consultation under a different name or on behalf of someone else are not allowed and will result in immediate exclusion of further access to our Services. If we discover that you have falsely pretended to be someone else, we will immediately terminate cooperation with you and with any relevant Healthcare Providers without separate notice.

Applicable law and dispute resolution

These Terms and all legal relationships arising from them are exclusively governed by Dutch law.

Disputes regarding these Terms or services provided via the Platform will be submitted exclusively to the competent court in the Netherlands.

Nullity of provisions

If any provision of these Terms is held invalid or unenforceable by a competent authority, the remaining provisions will remain in full force and effect.
In that case, the relevant provision will be replaced by a provision that is as close as possible to the purpose and scope of the original provision.

As soon as you enter into a medical consultation via our Platform with a Healthcare Provider, a treatment relationship (the “Treatment Agreement”) is established between you and this Healthcare Provider. 3CO is not a party to this agreement and bears no responsibility for providing care, medical advice, or prescribing medication as part of this relationship.
